I know there are several threads related to this topic but this is a different question a little more direct.

What would be an infringement if say I made models from a game series such as Halo and started to sell them on ebay, would that be an infringement?

Here is the catch though I wouldn't identify the models such as a Scorpion tank it'll have something a lot more generic although it looks exactly like a Scorpion tank.

I have made a few of these tanks in question but never sold them as profit, this is one of those "what-if" questions.

We are not a legal authorities. tThese threads tend to lead to the same conclusions. You know yourself that you do not have the right to sell something you do not have permission to. This is self evident. Make models, distribute them. Selling them is something we do not allow here. Companies that make models and sell them do so at their own risk. This forum is for displaying and possibly distributing models that you make. It is obvious that people make models of games, Science Fiction movies, etc, but they generally are not sold. WWII and other types of military items fall under a different category because of public domain and the ownership f the said objects are generally the taxpayers anyways. I would prefer that we leave it at that. Do what you wish, but don't expect to advertise something you do not have to sell here. Giving away a model is a different story. Even then, cease and desist orders can be given. Nothing can be solved here legally and legal advice cannot be given out here because no one here is a lawyer and even lawyers different on opinion, that is why there are Judges, and court hearings, etc., Build your models, show them. If you want to sell models on Ebay, that's your business. Unless it is an original creation, don't expect to advertise or link to it here. O.K.? :)

I wasn't going to do any such thing here. It was a simply an inquiry of something hypothetical that I may not even pursuit to find out for myself now that I'm beginning to understand the heavy legal issues involved.

Well someone would argue that these are big companies that make millions yearly and wouldn't bother with a single person with some talent.

Au Contraire... it is copyright for a reason. It does not matter if it is one person or a small firm they can ding you with a cease and desist order if they wanted to.

But why risk it?

One reason I don't like these types of threads is because they interest me and I can't help comment. There is truth in what you ay about making a small number of models. I know people who do that. They make nothing off of these models. They do it more as an interests in the model, or to cover their cost of producing a series of prints professionally. I think if you do something like that for yourself, or free, where you probably wouldn't be bothered, face it all the Star Wars models, no one will bother you. You start selling Star Wars paper models in you will probably be paying out in "in a Galaxy, near near by, very very soon"!

I'm sorry, I'm a bit of a pig on these issues....mainly because I offer a couple of kits through ecardmodels with name changes. "It's better to ask forgiveness than seek permission."

ahhh, poetry. No wonder I don't have a clue of what that mean. :l

You know in plastic models world, people makes aftermarket conversions kit. After that Marlboro F1 thing. I was thinking releasing my Marlboro as a conversions. Just the logo, noting else. And people can take my logo and overlay it on the original parts. That way, I am not rereleasing the original designer(s) works without their bleassing, just new decals, add-on parts to make it something else(just that the original designer released his Marlboro so I don have to). Anyway, I think that is one way not stepping on anyone lawn, maybe?

That is so weird, I was thinking about releasing a "free" full size P.T. Boat Hull for the one that has a "line" in it. Who's business is it. People release after market stuff all the time!! I don't see any problem with it myself. Especially if it is free.:twisted:

Watched the movie, I read my history books and that part using Chinese and Japanese quates in the same sentence made no sense to me either.

THAT IS A DISHONOR! You should now commit seppuku.
